General terms and conditions for purchases in this online store
1) GENERAL PROVISIONS
By placing a binding order, the Buyer confirms that he accepts the Business Conditions for the delivery of goods announced by the Seller. The relationship between the buyer and the seller is governed by these terms and conditions, which are also binding on both parties.
2) ORDERING GOODS AND SERVICES
We offer you the opportunity to buy directly from your home, where you can shop around the clock. You can order easily and conveniently using a shopping cart, phone or e-mail.
The subject of the contract is only the goods specified in the purchase contract - order. Dimensions, weight, performance, capacity and other information provided on our website, in catalogs, brochures and other publications are non-binding and based on manufacturer's information. In case of discrepancies, we will of course contact you.
We undertake to supply our customers only goods in perfect condition and in accordance with the specifications or properties common to the type of goods complying with the standards, regulations and ordinances in force in the Czech Republic and properly equipped with Czech operating instructions, warranty cards and lists post-warranty service centers if this is usual for the given type of goods.
The condition for fulfilling the validity of our electronic order is the completion of all required data and requirements specified in the order form. The order is also a draft purchase contract, where the purchase contract itself is subsequently created by the delivery of goods. Formal confirmation of the order by the seller is required to conclude the purchase contract. In individual, especially more demanding cases, the seller reserves the right to enter into a contract by confirming the order, preferably in person or by telephone, and payment of a financial deposit by the buyer.
In the event that during the time when the goods were ordered, there was a significant change in foreign exchange rate or change in price or range supplied by the supplier, our company has the right to modify the order in agreement with the buyer or unilaterally withdraw from it with immediate effect. We reserve the same right even if the manufacturer stops supplying the ordered product or launches a new version of the product or significantly changes the price of the product.
3) ORDER CONFIRMATION
The order is accepted within 24 hours, we will send you an order confirmation by e-mail, you will also be informed about the shipment by e-mail. In case of any ambiguity, we will of course contact you.
We send the ordered goods by the Czech Post and the PPL carrier cash on delivery. For orders over CZK 1,500, we send it free of charge. If you prefer a certain transport, write it to us in the order note. We will try to satisfy you.
Shipping in the Czech Republic: package in hand - CZK 93 incl. VAT, postal package - CZK 89 incl. VAT, PPL package - CZK 79 CZK incl. VAT, registered shipment by Czech Post - CZK 55 (applies to goods up to 300g)
When paying by cash on delivery, we charge a fee of CZK 30.
Package In hand - You specify the address where you want to deliver the package. We guarantee next business day delivery.
Package to mail - Select the mail to which you want to deliver the package. We guarantee you the possibility of collection the next working day.
Shipping to the Slovak Republic in the amount of 165 CZK all incl. VAT. We only send to Slovakia the PPL transport service.
5) DELIVERY TIME
Delivery time is within 2 days - Czech Republic, within 2 days - Slovakia, unless otherwise stated. In the event that some goods are not in stock, we will contact you immediately.
6) EXCHANGE OF GOODS
If necessary, we will exchange your unused and undamaged goods for another type. In this case, contact us either at email@example.com or 776 160 519. We will always agree and solve the problem to the satisfaction of both parties.
7) COMPLAINTS AND WARRANTY
We will handle any complaints to your satisfaction by an individual agreement with you and in accordance with applicable law. The buyer is obliged to inspect the goods after receipt to identify any defects and damage. The buyer is obliged to immediately report any defects to our company. We are not liable for defects caused by the carrier.
All goods are subject to a statutory period of 24 months, unless otherwise stated. The warranty only covers manufacturing defects.
The warranty does not apply to:
(a) defects caused by normal use
b) incorrect use of the product
c) improper storage
1) inform us about the complaint by phone, e-mail or in writing
2) send the goods as a registered package (not cash on delivery) to our address
3) state the reason for the complaint in the shipment, your address
4) proof of acquisition of the claimed goods in our store
Instructions on the right to withdraw from the contract
1. The right to withdraw from the contract
1.1. You have the right to withdraw from this contract within 14 days without giving a reason.
1.2. You have the right to withdraw from the contract without giving a reason within 14 days from the day following the day on which you or a third party designated by you take over the goods.
1.3. For the purposes of exercising the right to withdraw from the contract, you must inform the company NÁSTRAHY s.r.o., IČ 25172212, registered at the Regional Court in České Budějovice, dept. C file number 7694, VAT number CZ25172212, registered office Příběnická 1105, Tábor 390 01, telephone +420 776 160 519, 608 323 472, mail: firstname.lastname@example.org in the form of a unilateral legal action (for example, by letter sent through the postal service provider, fax or by e-mail). You can use the attached sample form to withdraw from the contract, but it is not your responsibility.
1.4. In order to comply with the deadline for withdrawal from this contract, it is sufficient to send the withdrawal from the contract before the expiration of the relevant period.
2. Consequences of withdrawal from the contract
2.1. If you withdraw from this contract, we will refund you without undue delay, no later than 14 days from the date of your notice of withdrawal, all payments we have received from you, including delivery costs (excluding additional costs incurred as a result of you). the chosen method of delivery, which is different from the cheapest standard delivery method we offer).
We will use the same means of payment you used to make the initial transaction to refund payments, unless you have specifically specified otherwise. In no case will you incur additional costs.
We will not refund your payment until we have received the returned goods or if you prove that you sent the goods back, whichever comes first.
a) Acceptance of goods
Send the goods without undue delay, no later than 14 days from the date of withdrawal from this contract or hand them over at the address of the company NÁSTRAHY s.r.o., Příběnická 1105, 390 01 Tábor. The deadline is considered to have been met if you send the goods back to us before the expiration of 14 days.
b) Costs associated with the return of goods
You will bear the direct costs associated with returning the goods.
c) Liability for reduction in the value of returned goods
You are only responsible for the reduction in the value of the goods as a result of handling these goods in a manner other than that which is necessary to become familiar with the nature and properties of the goods, including their functionality.
1.1. The language of communication between the operator and the buyer and the language of the purchase contract is Czech. The concluded purchase contracts are archived by the operator in electronic form and are not accessible to other persons.
1.2. In the event that any provision of these terms and conditions is invalid or ineffective for any reason, this fact does not cause the invalidity or ineffectiveness of other parts of the terms and conditions or the purchase contract.
1.3. The wording of the business conditions may be changed or supplemented by the operator. The changed business conditions are effective on the day of their publication. The rights and obligations of the operator and the buyer arising before the date of entry into force of the new wording of the terms and conditions are not affected by the change.
1.4. If the relationship established by the purchase contract contains an international (foreign) element, then the contracting parties agree that the relationship is governed by Czech law. This does not affect the consumer's rights arising from generally binding legal regulations.
1.5. The seller is entitled to sell goods on the basis of a trade license. Trade licensing is carried out within the scope of its competence by the relevant trade licensing office. The Office for Personal Data Protection supervises the area of personal data protection. To a limited extent, the Czech Trade Inspection Authority also supervises compliance with Act No. 634/1992 Coll., On Consumer Protection, as amended.
1.6. The contracting parties have agreed that the courts of the Czech Republic have jurisdiction to hear any disputes between the operator and the buyer. Any disputes between the operator and the consumer can also be resolved out of court. In such a case, the consumer may contact an out-of-court dispute resolution entity, such as the Czech Trade Inspection Authority, or resolve the dispute online via a dedicated ODR platform. More information on out-of-court dispute resolution can be found here. Before proceeding with the out-of-court settlement of the dispute, the operator recommends that the buyer first use the electronic address email@example.com to resolve the situation.

9) PROTECTION OF PERSONAL DATA
The seller processes personal data about the buyer exclusively for the purpose of fulfilling the rights and obligations under the purchase agreement. The seller is entitled to other processing of personal data about the buyer only with his consent.
